The Committee on Innovative Development and Information Technologies of the Legislative Chamber of the Oliy Majlis has begun preliminary discussions on a draft law aimed at strengthening intellectual property protection in Uzbekistan. The proposed amendments seek to introduce stricter penalties, including criminal liability, for violations of copyright, related rights, and industrial property rights.

The draft law suggests amendments and additions to the Criminal, Criminal Procedure, Administrative Liability, and Civil Codes. Notably, the current legislation’s liability measures for violations of personal non-property rights to intellectual property objects are being reinforced. Additionally, criminal liability is being introduced for infringements of property rights to such objects. The bill is expected to be discussed further in faction meetings of political parties.
Under the law on copyright and related rights, copyright protection in Uzbekistan applies to works authored by Uzbek citizens, permanent residents, and other original copyright holders. It also extends to works first published in Uzbekistan, regardless of the author’s nationality or residence.
Currently, Uzbekistan’s Code of Administrative Responsibility stipulates penalties for violations of personal non-property rights related to intellectual property.
For instance, unauthorized use of another entity’s trademark, service mark, geographical indication, or company name may result in confiscation of the infringing goods and fines ranging from 15 to 30 times the basic calculation amount. Repeat offenses within a year after an administrative penalty can lead to confiscation and fines between 30 to 50 times the minimum wage, equivalent to UZS 11.25mn to UZS 18.75mn ($868 - $1,448).
The proposed amendments also cover unauthorized production, sale, import, or circulation of patented inventions, utility models, or industrial designs. Violators could face fines ranging from UZS 1.875 to UZS 3.75mn ($144 - $289) for individuals and UZS 3.75mn to UZS 7.5mn ($289 - $579) for officials.
