Starting February 5, 2025, officers of the Russian Ministry of Internal Affairs (MVD) will have the authority to independently decide on the administrative deportation of foreign nationals for violations outlined in Russia’s Administrative Code (KoAP RF).
The legal changes, adopted in August 2024, expand the powers of law enforcement to address migration issues more directly and efficiently.
Details of the New Legislation
According to the official MVD website, “Officers of internal affairs bodies will be authorized to make decisions on administrative deportation of foreign citizens from Russia in cases specified by the Administrative Code of the Russian Federation.”
- These powers are granted to:
- Heads of territorial police departments and their deputies.
- Leaders and deputies of migration and narcotics control divisions.
- Heads and deputies of transport police departments for violations involving residency regulations.
In July 2024 the State Duma of the Russian Federation adopted a law on the expulsion of migrants.
Chairman of the State Duma Vyacheslav Volodin has this to say:
"Restrictions will apply to those whose documents have expired or have been cancelled, or if they have committed an offense," he said.
Now migrants who fit into these two categories will not be able to change their place of residence or leave the region without permission from the Ministry of Internal Affairs, and the police will be able to decide on their expulsion from the Russian Federation.
On January 2, it was announced that new legislation coming into effect on March 5, grants Russian police broad authority to enter the homes and residences of migrants residing in the country.
