Kazakhstan's President Kassym-Jomart Tokayev on July 10 inked the law 'On Online Platforms and Online Advertising,' which governs the activities of bloggers and internet resource owners who post paid content, media reports.
The law defines basic concepts, such as the definition of an influencer (blogger) as a user of an online platform who publishes information for business purposes to an undetermined circle of individuals.
According to the law,
false information includes untrue information or contains significant distortions of facts, creating a false image of persons, objects, events, phenomena, and processes recorded in any form.
The legislation also requires bloggers to mark advertisements to distinguish paid content from other publications and pay taxes on such posts under relevant legislation.
The law establishes a wide range of responsibilities for owners of online platforms, such as taking measures to prevent the dissemination of illegal content in the Republic of Kazakhstan, considering the request of the authorized body within 24 hours of its receipt, and immediately notifying law enforcement agencies if unlawful content is detected that poses a threat to the life or safety of a person or citizen.
Moreover, internet resource owners should work closely with state bodies that regulate online platforms. Sites with an average daily attendance of over 100,000 Kazakhstani users must appoint a representative in the country.
Online platforms should also integrate the Kazakh language into their resources, allowing for automatic content translation.
In addition to this law, Tokayev signed several amendments to existing legislation, imposing administrative fines for the placement and dissemination of unreliable information.
In Kazakhstan, spreading intentionally false information is a criminal offense with a minimum fine of $7,820 for the first violation and a maximum sentence of one year imprisonment. Nonetheless, the Prosecutor General's Office of the Republic emphasizes that administrative liability will be implemented as a preventive measure against more serious crimes.
The "On Online Platforms and Online Advertising" law, released on July 10, will take effect 60 days after publication.
