Artem Paliychuk, a resident of Crimea, has received 257 million rubles from the Jizzakh Battery Plant for the misuse of the brand. Kommersant reports with reference to the Arbitration Court of the Republic of Crimea.
Paliychuk filed a lawsuit in the summer of 2022, where he demanded compensation from the plant for using his KUCH trademark without his permission which was used by the Uzbek battery producer.
At first, the amount was $ 1.7 million, then he claimed $ 3.3 million. Although there were petitions to postpone or even dismiss the case, the court finally issued its verdict.
The Jizzakh Battery Plant stated that the claim was not subject to consideration in the arbitration court of the Russian Federation, since the firm was registered in Uzbekistan and the jurisdiction of Russia does not apply to it.
However, the court did not agree with the arguments of the Uzbek company, emphasizing that the plaintiffs caused financial damage harm in the Russian Federation.
The violation of the rights of the plaintiff as the copyright holder of the KUCH trademark was systematic, as it was allowed by Jizzakh Battery Plant JSC repeatedly in the period from 2019 to 2022. The amount of delivery, according to the specified customs declarations, amounted to $1.6 million, the decision of the Crimean court says.
The court decision has not yet entered into force and it can be appealed within a month.
