On June 26, the Yakkasaroy Interdistrict Court in Uzbekistan will hear a civil case involving Tatyana Karimova, the wife of the late first president of Uzbekistan, Islam Karimov. The case revolves around a dispute related to the right of succession. The "Daryo" reporter interviewed lawyer Bakhodir Akhmedov to shed light on how this matter between the succession and the Karimovs will be resolved.
Succession, as defined by the Civil Code, is the transfer of property from one person to another after their death. There are two forms of succession: testamentary, which is based on a person's will, and legal succession, which follows the laws of inheritance. The details of the dispute between the Karimovs are not known, but it may involve disagreements regarding a will left behind by the late president.
If no will exists, the heirs must resolve any disputes among themselves. If they cannot reach an agreement, the court will intervene. According to Article 1114 of the Civil Code, jointly-owned property is subject to inheritance. For instance, if the property belonged to Tatyana Karimova before, and Islam Karimov had no property, then half of Tatyana Karimova's property would belong to Islam Karimov, with the children also having inheritance rights.
In terms of the distribution of property, the "first line of succession" consists of children, parents, and the spouse. In this case, if Islam Karimov had three children, they would each be entitled to one share of the property, and Tatyana Karimova would also receive one share.
The heirs can choose whether or not to accept their inheritance voluntarily. They have the option to renounce their rights in favor of someone else. For example, they may decide to pass their share to a sibling or relative.
The court proceedings will likely involve other potential heirs and may explore possibilities for settlement or mediation. If the properties in question are located abroad, the court system of that particular country would have jurisdiction over the case.
Notably, Petr Karimov, son of Islam Karimov, who was previously arrested in Russia on suspicion of assaulting his wife, is expected to participate in the inheritance court proceedings in Uzbekistan.
