The law defining the legal basis of this constitutional guarantee was signed by the head of state.
According to the document, the complete list of purposes that are the basis for taking land plots for public needs is being approved. Now, the Law prohibits plot seizure for public needs in any cases except for 6 purposes that are truly public needs.
"Another achievement of the law is that a plot can be taken only as a last resort when there is no other way to fulfil public needs and must be fully substantiated.
Now the following rights are clearly defined as compensation:
• market value of real estate objects; the market value of the right to the confiscated land plot (except for agricultural land);
• market value of perennial trees;
• expenses related to moving and temporarily renting another house;
• lost profit that can be obtained from the use of the land plot and real estate objects located on it;
• other costs and damages of the right holder.
"A new type of compensation will be introduced, which does not exist in most countries. A one-time payment of 5% of the real estate market value will be made for the inconvenience caused to the right holder.
Another important guarantee is that the owner of the right will be fully compensated for the arbitrarily built residential and non-residential premises.
In addition, the scope of housing compensation for demolition has been expanded - now even if houses located within the settlement, but "without cadastre", are demolished, if taxes on this land have been paid for more than 15 years, compensation will be provided. is paid. So to speak, this law "insured" about 3 million undocumented homes from demolition.
