President Shavkat Mirziyoyev touched upon the changes in the field of the judiciary, which is one of the priority directions of the country's development during his address to the Oliy Majlis on December 22.
First of all, the system of an "online selection" of lawyers, provided free of charge at the expense of the state, should be fully put into force. The lawyer who provides assistance at the expense of the state simply is a puppet that plays the "role of a defender". The lawyer’s participation became just a formality that only takes money from the state budget. A corrupt investigator calls a lawyer to simply sign the documents. As a result, the rights of the individual were not protected, and the state's money is embezzled. Now, the rights given to the defender in ensuring justice will be revised, and insufficient powers will be provided. The criminal case is admitted to the courts not only with the indictment but also with the defence counsel's opinion.
It is envisaged to introduce a system in which the prosecutor and the court will carefully study every case of the defendant's refusal to have a lawyer. The importance of this is that in some cases, the accused person gives up his defence under external pressure, supposedly "of his own free will". Why?
Maybe because the defender has no money, or he is coerced to do so. All these cases will be studied by the prosecutor and the court. It helps to organize the proper functioning of the principle of the dispute between the parties at all stages of court proceedings.
The initiatives put forward by the president help to raise the reputation of the legal institute, attract young personnel, strengthen the trust in lawyers among the population, to provide people with quality legal assistance in local areas.
