The Uzbek legislators of the Oliy Majlis considered the draft law on amendments and additions to the Criminal Procedure Code in the first reading. This was reported by the information service of the chamber.
Shuhrat Polvanov, Deputy Chairman of the Supreme Court, spoke at the meeting about the need to adopt this law.
'The analyzes conducted on the institution of review of court decisions introduced on the basis of the principle of "one court - one instance" show improvement of this institution which envisages checking the legality, reasonableness and fairness of court decisions limits the effective use of the capabilities of middle level - regional courts. In 2020, the Supreme Court considered 1,291 cases, and in 2021, this figure reached 7,560. In the ten months of 2022, it was 5,540. That is, the number of cases heard in the Supreme Court has increased several times.'
As a result, the volume of work in the Supreme Court has increased sharply, and citizens are forced to come to the Supreme Court from distant regions, spending excessive time and money. In addition, as a result of the increase in the volume of work in the Supreme Court, in some cases, it has a negative impact on the violation of the terms of consideration of cases and the quality of work of judges.
The norms defined in the draft law will increase the responsibility of the courts, ensure high-quality and timely processing of cases, make wider use of the opportunities of regional and equivalent courts in revising court decisions and prevent unnecessary wanderings.
Speaker of the Legislative Chamber of the Supreme Majlis Nuriddin Ismailov said that the independence of the court is a complicated process.
“Deputies, senators, everyone, our whole society is in favour of ‘Judicial independence'. But we are surprised to see how complicated the process is for the court to become independent. The president met separately with the courts and even created the body of a human resource. The commission that ensures the independence of the court worked alternately in two chambers every year. Many laws have been adopted. People want a real independent judiciary. Including us. Therefore, this law is very important. We need to consider every word of the document without melting it, and we have to speed up the process of its adoption," said the official of the lower chamber.
