In a significant move aimed at refining the conditions, norms, and procedures surrounding pension provision for judges and their family members, Uzbekistan has introduced notable changes and additions, resolution of the Cabinet of Ministers of Uzbekistan, No. 630 showes on Lex.uz.
The government's decision underscores a fundamental criterion for judges to qualify for a pension – maintaining an impeccable reputation throughout their tenure until retirement age. This criteria shift is pivotal in determining judges' eligibility for pension benefits.
The amendments explicitly outline instances where judges will be ineligible for a pension upon premature termination of their mandate. These include violations of the judge's oath, continued engagement in activities contrary to the role of a judge after warnings from the qualification panel, loss of Uzbekistan citizenship, and actions leading to disciplinary measures resulting in the termination of judicial powers by the relevant panel.
Furthermore, the decision introduces an exception for judges re-elected or re-appointed before the conclusion of their current term. In such cases, up to six additional months will be added to the judge's length of service, acknowledging their ongoing commitment to the judiciary.
Addressing the transition from active service to retirement, the government decision ensures that in the event of a judge's death, the unpaid pension amount for the three months following the pensioner's passing will be paid in full. This adjustment aims to provide financial support to the family during the initial months following the loss of a retired judge.
