    Kyrgyzstan proposes progressive resolution to enhance rights and identity for stateless individuals

    In a significant move towards upholding the rights and dignity of stateless persons, the Ministry of Digital Development of Kyrgyzstan has proposed a draft resolution that aims to establish a streamlined process for determining the status of stateless individuals and issuing identity cards. This progressive step is currently open for public discussion and represents a significant shift in Kyrgyzstan's approach to statelessness.

    The proposed amendments are set to impact several key laws, including "On External Migration," "On External Labor Migration," and "On the Legal Status of Foreign Citizens in the Kyrgyz Republic." The primary focus of these amendments is to create a more inclusive and just system for stateless individuals residing in Kyrgyzstan.

    At present, Kyrgyzstan issues stateless person's certificates exclusively to those who require them for international travel. However, this comes with the condition that the individual possesses a permanent residence permit within the country. The proposed draft resolution aims to alter this requirement, allowing stateless persons to obtain identity cards regardless of whether they hold a residence permit or not.

    Under the envisioned procedure, individuals seeking to establish their status as stateless within Kyrgyzstan will need to contact the territorial branches of the Department of Population Registration. These branches will be tasked with creating special commissions responsible for determining an applicant's stateless status. Only after a thorough evaluation and consideration of the application will a stateless person's certificate be issued.

    Stateless individuals often face numerous challenges in their daily lives, ranging from restricted access to essential services to limitations on their employment opportunities. By removing the requirement of a residence permit for obtaining identity cards, this draft resolution promises to significantly alleviate the hardships faced by stateless persons in Kyrgyzstan.

    The Ministry of Digital Development's proposal reflects a growing global commitment to addressing statelessness and ensuring that every individual, regardless of their citizenship status, is afforded basic rights and recognition. While the draft resolution is currently in the public discussion phase, it holds the potential to become a pivotal step towards a more inclusive and compassionate society in Kyrgyzstan.

    To date, there has been no formalized procedure for determining the status of stateless individuals and issuing corresponding certificates within Kyrgyzstan. With this proposed resolution, Kyrgyzstan is poised to join the ranks of countries taking concrete steps to recognize and protect the rights of stateless persons, providing them with a pathway towards secure and documented identities.
