The Thirteenth Arbitration Court of Appeal in St. Petersburg and the Leningrad Region confirmed the decision to cancel Carlsberg Kazakhstan's exclusive license for the Baltika brand in six CIS countries and Mongolia.
The lawsuit stemmed from a license agreement signed on July 19, 2023, between Baltika and Carlsberg Kazakhstan. Despite Carlsberg Kazakhstan's challenge, the court upheld the initial decision to invalidate the agreement.
The agreement transferred the exclusive license for intellectual property related to Baltika's products and brand for use in several countries, including Kazakhstan, Uzbekistan, Kyrgyzstan, Ukraine, Tajikistan, Mongolia, and Turkmenistan. This included intellectual property rights in brand design elements and variants, know-how, and trademarks.
Denis Sherstennikov, former president of Baltika, was arrested for alleged fraud related to the transfer of rights to original beer brands to Carlsberg in November 2023. Anton Rogachevsky, Vice President of Baltika, was also detained. The Ministry of Internal Affairs of St. Petersburg and the Leningrad region estimated the damage to the state at almost RUB 300 mn ($3.3 mn).
