As of August 26, 2023, the Agency for the Protection and Development of Competition of the Republic of Kazakhstan has introduced rules for assessing the impact on competition. These rules have been developed to ensure that regulations that govern business are fair and do not hinder competition.
The competition impact assessment is a necessary step in regulatory impact analysis, and the rules outline the objectives, time frame, and procedures for conducting such an assessment. When evaluating the impact on competition, the draft of the relevant normative legal act and general information is sent to the Agency for the Protection and Development of Competition of the Republic of Kazakhstan.
The competition impact assessment period is fifteen working days, but it may be extended once for another fifteen working days if an in-depth assessment is required. The objectives of the assessment are to prevent the restriction or elimination of competition, improve the functioning of commodity markets, limit state participation in business, and reduce excessive government regulation.
The order of the Agency for the Protection and Development of Competition of the Republic of Kazakhstan, dated August 10, 2023, 198/HK, came into effect on August 26, 2023.
